"Costa Concordia: Rock Not Charted or Erroneous Navigation?

On the evening of Friday, 13th January 2012, the cruise liner Costa Concordia grounded near the Italian island of Giglio after hitting an underwater rock. This tragic event has raised various questions, including whether the ship was navigating too close to the shore and whether the rock was properly charted.
The vessel was in touristic navigation, passing by the picturesque island Giglio. This is a manoeuvre which is done from time to time. However, this time, the vessel approached the coast very close to the dangerous Le Scole reef area. The minimum distance to the shore usually is a couple of miles. Even inhabitants of the island remarked that the cruiseship appeared to be closer than usual.
According to several sources, the captain of the Costa Concordia has stated that the rock the ship hit was not charted. The vessel has a draught of 8.2m and was sailing approximately 300m out from the shore and the rocks. The area is said to be well-charted, and the place is used for diving and sailing which makes it well-known.
It is not completely clear where the Costa Concordia hit the rock. According to AIS sources, the vessel may have tried to navigate between two rocks with a depth of 10.3m.
After the incident, the vessel navigated close to the shore, towards the harbour. When turning, the vessel listed to one side, which was critical in view of the shallow waters.
The position is not yet stable: on Monday, 16th January 2012, the Costa Concordia moved 9cm downwards. If this continues, due by bad weather for example, she may even slide from the rock, potentially to a depth of 100m.

ADDITION 18th JANUARY 2012
According to Lloyd's List on BBC, the Costa Concordia followed a comparable route in August 2011. No rocks are shown on the UK Hydrographic Office's charts, but the UKHO has stated that this could be due to the small scale of its charts, whereas Italian charts are available on a much larger scale.
The Italian Hydrographic Office is working on a detailed study regarding the charting and survey situation of the location.
A potential source of a new 'liability for GI/map/chart data' case building up? We haven't had many in the past fw years.
But also have a look at this 14 min video tracking the last minutes of the Concordia's approach to the shore - and the basic navigation mistakes that seem to have been made - as well as the fact that the rocks that the vessel first hit are clearly visible on the charts! No escaping the ever present AIS (Automatic Identification System) data.

The two-day meeting will give the opportunity to publicly present the state of the art of the LAPSI policy recommendations on Public Sector Information (PSI) re-use. The featured policies focus on some of the major legal topics involved with the re-use of PSI; in particular, intellectual property rights issues, privacy, data protection and personal data processing, competition law aspects,regulatory bodies.

"Data Protection and Freedom of Information Authority in Hungary since January 1, 2012

Significant development in the Hungarian public administration for the protection of citizens has been achieved by setting up a Data Protection and Freedom of Information Authority (in Hungarian: Nemzeti Adatvédelmi és Információszabadság Hatóság). This authority keeps the functions of the previous data protection ombudsman. Having a broader authority in case of abuse of personal data, fines of up to 10 million HUF might be imposed even repeatedly. Attila Péterfalvi, an earlier ombudsman has been appointed by the State President as head of Hungary’s National Data Protection and Freedom of Information Authority for nine years. The independence of the new authority is ensured by legal guarantees and the length of his term spans government cycles. The website of the authority will open under www.NAIH.hu in January. Another important development is the new Act No. CXII of 2011 on Information Rights and the Freedom of Information, which replaced the former Act No. LXIII of 1992 on the Protection of Personal Data and the Publication of Data of Public Interest by 1 January 2012. New Guidelines to RFID Privacy Impact Assessments

On 25 November 2011 the German Federal Office for Information Security (BSI) and the Institute for Management Information Systems of the Vienna University of Economics and Business (WU) held an expert symposium on RFID Privacy Impact Assessments in Berlin and presented their BSI Privacy Impact Assessment (PIA) Guidelines.

The PIA guidelines are based on the RFID PIA Framework, a kind of co-regulation instrument that was signed by Vice President of the European Commission Neelie Kroes and industry representatives earlier this year. The goal of the guidelines is to explain the PIA Framework and to provide RFID application operators with an in-depth understanding of the framework terminology and proposed procedures. The methodology outlined in the document is understood to be a concretion of the generic process outlined in the PIA framework.

The PIA guidelines will help European RFID operators to ensure a high level of data protection, which can be seen as an important aspect of quality and a unique selling proposition for European companies, said Professor Sarah Spiekermann, Head of the Institute for Management Information Systems. The PIA guidelines are available from the symposium website. PIA case studies for three different sectors will soon be published by BSI.

In his presentation at the symposium the German Federal Commissioner for Data Protection and Freedom of Information, Peter Schaar, explained that, while Data Protection Authorities (DPAs) might not be able to check each and every PIA report, in future, the results of privacy impact assessments and the implementation of their results will be important aspects in data protection inspections. He therefore asked, that PIA reports and the data protection goals identified in the course of the PIA process should be made transparent to DPAs and individuals.

Furthermore, Mr. Schaar called for PIA frameworks being defined on the European level and for the establishment of a European data protection competence centre, which should work on technical means and measures for data protection.

The European Data Protection Supervisor, Peter Hustinx, stressed in his contribution the need to reduce the unhelpful diversity in EU member states' data protection legislation. While there is no need to reinvent data protection, it is necessary to make the current principles work better, to improve the definition of responsibilities and to ensure a better compliance, he said. With regard to privacy impact assessments, Mr. Hustinx envisaged that these could be optional in some cases while being compulsory in others.

A coherent European approach to the implementation of the RFID Privacy Impact Assessment Framework will be in the centre of a conference organised by the European Commission on 8 February 2012 in Brussels, where experiences with the PIA Framework and the future of the European Commission's RFID Recommendation will be discussed.

As EDRi already expressed earlier, the success of RFID Privacy Impact Assessments will, to a large extend, depend on the quality of the assessment. In particular, it will be crucial to address and eliminate risks that stem from third parties and are not directly related with the RFID applications operated by a given company, but facilitate the RFID tags disseminated by the company.

II. Public Conference and Award: Advertising

The LAPSI Coordinator is advertising the LAPSI public conference and the LAPSI award via several sound boxes, such as the local newspaper La Stampa, the Torino Law School press office, several mailing lists (Nexa, OKF, SharePSI, OpenGov, Internet Governance, WIPO LLM, Euopendata).

Some days ago I sent you a personal e-mail with a short post on the public conference and the award that may be disseminated for advertising purposes. Many of you have already indicated how they are disseminating this post. I really thank you for the collaboration so far. However, please let me encourage you to keep disseminating this post (and inform me on any further dissemination initiative). This is of essence not only for the success of public conference, but particularly for the LAPSI award (so far we have a very limited number of applications and we do count on your initiative for receiving as many aapplications as possible).

III. Website.
As you know, my colleague Claudio is constantly taking care of the content of the LAPSI website. He recently improved the page "Members" where he introduced the logo of each and every LAPSI partner. "A quick update on the Palermo session of "Digital Agenda Going Local" - jointly organized by the European Commission and Italian national and local authorities - which I attended yesterday on behalf of Nexa and the Lapsi Network. The workshop was aimed at assessing the current achievements and the remaining challenges with respect to the Digital Agenda key objectives, especially at local level.

I participated into a panel focused on the Open Data (PSI) implementation processes, together with representatives from Italian bodies and the EC as well.

We were informed that further insights on the foreseen modifications of the PSI Directiveshould be released rather soon. Moreover, the EU open data portal is to be released by Spring 2012. It is also planned to use such portal as a platform that federates the National portals (by 2013). Moreover, the forthcoming Horizon 2020 programme will cover specific themes regarding Open Data.

I had the chance to present LAPSI as a European network of researchers and institutions providing policy support on the key legal aspects of PSI. Furthermore, I highlighted the role of the regional dimension of PSI (using Piedmont and Italy as examples) with two complementary trends: regulatory competition (valorisation of the distinctive advantages of regions) and cooperation based on best practices, also exploiting network effects (each time a new region opens up data the value of the datasets already provided by first movers is increased).

8. EP Hearing "Copyright and Intellectual Property in the Digital Age"

The Socialists and Democrats Group in the European Parliament held a hearing
on Copyright and Intellectual Property in the Digital Age" in the European
Parliament (EP) on 29 and 30 June 2011. The event was organised in order to
permit a balanced and calm discussion ahead of the launch of a range of
intellectual property proposals from the European Commission over the coming
months.
The event was chaired by Maria Badia i Cutchet MEP (Spain) and Luigi
Berlinguer (Italy) and was well attended by parliamentarians.
The first speaker was Malcolm Hutty from the European ISP Association
(EuroISPA). He expressed concern not just at the amount of copyright
infringements, but also at the fact that the legal framework has led to a
whole generation growing up with a lack of respect for the law. He argued
against repressive measures such as "three strikes" and blocking/filtering -
both of which are contrary to existing policy priorities such as promoting
access and consumer protection. He called for a move away from
repression-by-default and towards measures to create respect for the law -
and a more respectable law which allows reasonable exceptions, reasonable
pricing and reasonable innovation. He used an example a DVD rental
service which allowed online streaming of the product, using exactly the
same payment model for rightholders as an offline DVD rental service but
which was nonetheless objected to by rightholder groups simply because it
was new.
He was followed by Jean Bergevin, head of the "fight against counterfeiting
and piracy" unit of DG Markt of the European Commission. He stressed the
global, fast-moving nature of the Internet, which is an integral part of all
content distribution and which offers key opportunities to exploit niche
markets, particularly thorough the simplification of the supply chain. He
questioned whether there has been enough innovation and whether the
cross-border delivery of content is matching the increased mobility and
linguistic skills of citizens. He stressed the obligation under the Lisbon
Treaty to ensure that any proposals fully respect the Charter of Fundamental
Rights. He said that any new proposals must ensure that supply of content is
maximised and gave the examples of the proposals of the Commission on orphan
works, collective rights management and cross-border licensing as
initiatives aiming to achieve this goal. Regarding the IPR Enforcement
Directive, the aim should be to ensure that all rightsholders, however
small, can enforce their rights. He said that existing business models are
threatened and this is causing resistance. On the other hand, consumers need
to move away from the concept of "free," although affordable access is
necessary. He concluded by stating that a political will for modernisation
was necessary.
The final presentation on the first day was from the Spanish academic
Enrique Dans, who had a stunning presentation on the need to update
thinking on intellectual property and access to audiovisual material. He
described the resistance to every form of new content distribution
throughout history, from the printing press to sheet music to audio
cassettes to video cassette recorders - except CDs, which were cheaper to
produce and could be sold for higher prices. He said there is no way to stop
technology and technology is undermining industries in the middle of the
distribution chain. Physical copies are no longer needed , marketing
happens via social media, talent is found increasingly via viral means. As a
result, the middlemen are no longer adding value and are demanding
subsidies, such as via equipment levies - in Spain the levy on a CD is
higher than the cost of the CD itself. Consumers are tired of being treated
as criminals for sharing culture. Copyright is a dead horse - it is time to
stop trying to legislate the horse back to life. "Piracy" is not lowest
where there is the most enforcement - it is lowest where legal content is
the most easily available.
On the second day, the discussion was divided into two sections. The first
was "jobs and intellectual property - the way forward" while the second was
"the role of the legislator - in defence of what? Protection of intellectual
property, privacy and data"

Johannes Studinger from the UNI MEI trade union, representing a wide range
of workers, mentioned the history of the Socialists and Democrats in
supporting workers and trades unions. He described how trades unions
negotiate collective agreements with producers, which are important due to
the instability of work in the media sector. Such agreements provide
stability for workers and guarantee remuneration where works are re-used.
This money is also used for health payments. Enforcement is important
because if there are infringements, these collective agreements are less
easy to sustain.
Smari McCarthy from the International Modern Media Initiative (IMMI)
said that copyright was becoming a primary tool for censorship but it was a
very contentious issue and the need was to get to a better model that
benefited everybody. He said that the phrase "intellectual property" was a
misnomer for a temporary property right. It is also incorrect to argue that
copyright is needed to ensure creation - creators only receive a tiny
percentage of income, the record companies get the vast majority of the
revenue.
This approach is leading creators to turn to creative commons models and
earning money from associated merchandising. Vested interests, particularly
with regard to collective licensing, are holding back development. In the
last decade, we have come up with more and more enforcement that creates a
chilling effect and extra-judicial powers for intermediaries. These measures
are circumvented and ineffective. We need to focus on promoting education
and creation in policy development.
B. The role of the legislator
Christophe Geiger from the University of Strasbourg said that law was about
social order and this was achieved by a balance between competing interests.
This balance is what legislators must achieve. Citizens use and reuse
cultural material and access to culture must be taken into account. We need
to ensure just payment for creators and to ensure access and reuse. What is
a "balance"? We need to focus on measures to increase access and we need to
make sure that these are efficient - an observatory body for access along
the lines of the observatory for counterfeiting would be good. Allowing
access does not mean that access should be free. Legal use of works should
also be looked at, with single window systems - it makes no sense to have 27
different licensing systems. Exceptions and limitations are key tools for
access, particular for non-commercial uses, such as research and education.
We also need an exception for creative purposes. We need to consider an EU
copyright regime - copyright is not just a legal issue, it is a societal
issue. When rules are not accepted, it is difficult to apply them. We need
to get back to basics.
Joe McNamee from European Digital Rights said that it was important for
legislators to learn from successes of the past. Legislators did not listen
to the objections of old telecoms monopolies and forced them to liberalise.
Despite their objections, this turned out to be hugely beneficial for them.
Legislators did not listen to the music industry that complained that audio
cassettes were "killing the music industry" or that video cassette recorders
were as dangerous for the film industry as the Boston strangler was for
women home alone. If legislators had listened, they would have robbed the
film industry of subsequent revenues from video sales and rentals. It is
normal for comfortable old and rich industries to resist change, even
beneficial change, and it is the duty of legislators not to be swayed by
their lobbying. On the other hand, it is also important to use legislation,
where this is proven necessary, rather than outsourcing the powers of the
state to private entities. It is precisely for this reason that the European
Convention on Human Rights, the European Charter of Fundamental Rights and
the International Covenant on Civil and Political Rights require
restrictions on fundamental rights to be based on law. The trend towards
entrusting regulation of freedom of communication to internet intermediaries
is undemocratic and dangerous and must be opposed by legislators.

New Remote Sensing Data Policy in India

The Government of India has unveiled a new remote sensing data policy which allows all data of resolutions up to 1 meter to be distributed on a non-discriminatory basis and on "as requested basis".
The Remote Sensing Data Policy 2011 (RSDP 2011) replaces a 2001 policy which allowed all data of resolutions up to 5.8 metres to be distributed on non-discriminatory and âas requestedâ basis.
The RSDP 2011, apart from opening up the remote sensing sector, will remove certain restrictions to facilitate more users to access high resolution data for developmental activities.
The RSDP however with a view to protect national security interests states that all data of better than 1 meter resolution shall be screened and cleared by the appropriate agency prior to distribution.

The policy adds that government users namely, ministries, departments, public sector, autonomous bodies, government research and development institutions, government educational, academic institutions, can obtain the data without any further clearance.
But private sector agencies which support developmental activities will need the recommendation at least by one government agency.

The presentation emphasized the roles of licenses
based on a dramatized performance played by an expert guide and a lay Dutch tourist. The story developed from the question how to produce value added product merging information gained simultaneously from existing official Ordnance Survey map, from open source data using openstreetmap product, and from a snapshot which was taken by a private person. To offer feasible common global licensing policy, different existing models used worldwide will be surveyed and evaluated by the GSDI Legal & Socioecon Committee, where experts are welcomed from any part of the world.

A Századvég Alapítvány szervezésében idén Budapesten kerül sor a rendezvényre, melyen 250 hazai és 15 külföldi civil szervezet vesz részt. A konferencián való HUNAGI részvétel motivációja az volt, hogy a térinformatika területén az egyének önkéntes közreműködése ill. bevonása az adat és információgyűjtésbe világszerte, így Európában is az egyik legmeghatározóbb új irányzat. Subject: Data protection of location data collected by smartphones and tablets
The Commission is currently considering a revision of the Data Protection Directive. The Article 29 Working Party on Data Protection, which advises the Commission, makes clear in its report of 16 May that current European law cannot guarantee protection of European citizens' data.
In particular, the potential misuse of consumers' personal location data which, thanks to modern technology, is stored in smartphones and tablets and is also passed on to third parties, is a direct threat to the privacy of the consumers. These location data in combination with other data provide a mine of information about the consumer's private life.

The registered location information is collected without the consent of the user, and the data are stored for long periods.

Will the Commission take account of the advice of the Article 29 Working Party on Data Protection in its plans for revision of the Data Protection Directive, so that operators and manufacturers are obliged to ask for the users' consent with regard to the use of location data?"

The Board of Research Data and Information (BRDI) at the U.S. National Academies co-sponsored a free, two-day symposium on international scientific data sharing, with focus on developing countries. The presentations from the event are available online.

The symposium sought to address the following questions:
1. Why is the international sharing of publicly funded scientific data important, especially for development? What are some examples of past successes and what are the types of global research and applications problems that can be addressed with more complete access to government data collections and government-funded data sources?
2. What is the status of public data access internationally, particularly in developing countries?
3. What are the principal barriers and limits to sharing public data across borders?
4. What are the rights and responsibilities of scientists and research organizations with regard to providing and getting access to publicly funded scientific data? How can international scientific organizations, government agencies, and scientists improve sharing of publicly funded data to address global challenges, particularly in less economically developed countries, more successfully?"

Let me add that whenever you have a suggestion for the LAPSI website, you should not hesitate to share it, so that we can improve the website further. 2. Next meetings: London October 20th and 21st -- Brussels January 2012. Thematic Seminar on Selected Deployment and Implementation Issues (with particular attention to the introduction/action of a regulator) and Internal Conference (submission of first policy recommendations of WG1 and WG5).
I have already started to plan these meetings with Prodromos Tziavos (City University of London - host). However, any suggestion is welcome from the WGs of reference and from the LAPSI partners/Advisory Board Members. The program will circulate on this mailing list as soon as it will be drafted. And it will be uploaded on the website as soon as it will be approved by the WG4, the Coordinator, and the Project Officer.
After that meeting we will meet in Brussels on January 2012 for the second LAPSI public conference. The idea is that during that conference each operational WG will present at least one policy recommendation which will be discussed by experts. I have already started to plan this with Cristina Dossantos (CRID). Considered the efforts required in organizing a public conference, should anyone wish to be involved in it, feel free to inform me at your earliest convenience.
3. WGs. The forthcoming meetings will give the chance to submit to the plenary in October and to a broader public in January policy recommendations of several WGs. In particular WG1 and WG5 will submit some policy recommendations in London. The other WGs will submit their policy recommendations in Brussels. "I have worked my way through the slides and notes of the SharePSI workshop in the past days. In total just under a hundred barriers were identified, and over 640 solutions/drivers/interventions to surmount those barriers.

That list of barriers and solutions I've then tried to map and cluster, to see what patterns emerge. Those patterns have formed the basis for the discussion summary that is now finished in draft and which I just sent to the EC, Margot and Thomas for feedback.

Clusters in barriers that I see:

Access to data
Getting from access to reuse to viable business models (the innovation path, transition path for reusers)
Transition of government
Cost of transition
Disrupting existing markets and existing government revenue models
Linked and federated data as step to maturity
Licensing
Privacy

When it comes to suggestions and tried solutions to surmount those barriers you see they cover those same barrier clusters (not surprising, as most barriers were mentioned in the context of also mentioning ways of overcoming them)

What also stands out is that "it must come from the top, the middle, and the bottom" is visible in the suggested solutions, but also several other axis of action:

- small to large scale efforts

- short term, medium term, long term actions and aims

- facilitating the transition, vs creating the 'new normal'

and as mentioned

- top, middle, bottom

On all those axis, at each point along the scale, actions/solutions are mentioned. Together we as stakeholders are taking it all on, and all in parallel. Doing things here and now, but with the horizon in mind, you could say. Also because smaller, nearer things help build the case for larger, longer things. "Nobody knows what this is about yet" sums it all up quite nicely (and I mean that in a positive way)

With the summary written (you can see and comment it here https://daa.co-ment.com/text/GXXnDNBIU68/view/ ), I am now building a few images to show all the remarks as they form the clusters.

I've finished two maps of the first few clusters of barriers, will continue to build more images.

II. Szakmai beszámoló

A leuven-i Katolikus Egyetemen került megrendezésre 2011. március 18-án a „Földrajzi adatok jogi szempontjai” című munkaülés, melyen a HUNAGI képviseletében vettem részt. A munkaülés 4 szekcióba tagolódott, melynek első két része a licencelési politikákkal, a harmadik a helyzettel kapcsolatos bizalmassággal, míg az utolsó részben az adatokhoz való hozzáférés jogáról volt szó.

Az első ülést M. Dulong-Rosnay a francia Nemzeti Tudományos Kutatási Központ munkatársának előadása nyitotta meg a licencelési polikákról. Előadásában kiemelte a licencek harmonizálásának szükségességét, mivel európai, sőt világszinten is igen változatos a helyzet ebben a témában. Jó példaként megemlítette az Angliában a földrajzi adatokon alkalmazott, viszonylag nyitott ún. „Open Government Licence”-t, míg ellenkező példaként a belga IGN-t hozta föl, ahol minden jogot az adatokkal kapcsolatban az IGN magának tart fenn. A különböző licencelési politikák közül megemlítette a nem kereskedelmi licencet (pl. oktatási intézményeknek), a teljesen nyitott licencet (lásd. Open Street Map) és az ún. „részvényhez hasonló” (share alike) licencet. Ebben a licencelési politikában külön kezelik az adatokat és az adatbázisokat. Minden ebből levezetett adatbázisnál az eredeti, kompatíbilis licence van érvényben, így egy felhasználónak nem szükséges minden egyes esetben a licencet megújítani.

A második előadásban Paul Uhrir, az egyesült államokbeli Nemzeti Akadémiától, A GEOSS (Global Earth Observation System of Systems, a Rendszerek Globális Földi Észlelési Rendszere) adatpolitikájáról tartott előadást. Kiemelte, hogy egy ilyen globális kiterjedésű rendszernél nagyon fontos az adatmegosztást megfelelően meghatározni. Megemlítette, hogy a GEOSS munkacsoportot hozott létre 2008-ban, mely csoport beszámolóját elfogadta a GEOSS 2010-es pekingi közgyűlése. Ebben a jelentésben lefektették egy teljes és nyitott adatcsere alapelveit, melynek megvalósítására 2011-ben kerül sor. Ebben három kategóriába sorolják a licenceket: Alapadatok (Data Core) , Nem kereskedelmi célú és egyéb célú felhasználásra. Megerősítette, hogy szükség van a licencek harmonizálására és a kiterjedésük csökkentésére. Az angliai példát, egyszerűsége miatt, ő is megemlítette.

A második részben Bastiaan van Loenen a Delfti Műszaki Egyetemről (Hollandia) tartott előadást a licencek szabványosításáról. Véleménye szerint a szabványos licencek növelik az átláthatóságot, melyre minden területen nagy szükség van. Szólt az INSPIRE direktívához kapcsolódó licencelési politikáról (alap és specifikus licencek), valamint a GSDI licencelési keretrendszeréről.

A második részt vita követte, melyen megemlítették, hogy Dr. Remetey-Fülöpp Gábor (HUNAGI) elnökletével létrejött a GSDI-on belül egy jogi és szocio-ökonómiai bizottság, mely nemzetközi szintű konzultációt folytat a témában, mely 2011. december végére zárul le. 2012. májusában egy második jelentést készítenek a témában. A vita során még felmerültek kérdések a személyes adatok kezelésének licenceléséről, arról, hogy a Közszervezeteknek szóló licenceket egyszerűsíteni kellene. A földrajzi adatok kereskedelmi és nem kereskedelmi felhasználásának elkülönítésére, definíciójára még nem találtak igazi megoldást.

A helyzettel kapcsolatos bizalmassági kérdésekkel Eleni Kosta, a leuven-i Katolikus Egyetemről, érdekes kísérletről számolt be, amelyben a mobiltelefonok helyzete alapján követtek néhány embert (természetesen az egyetem hallgatóiról volt szó, akik erre áldásukat adták) és elemezték azok tevékenységét, mozgásuk alapján. A kérdés ebben az esetben az volt, hogy a mobilszolgáltatók elvileg teljes mértékben nyomon tudják követni az egyes állampolgárok mozgását, ebből következtetéseket tudhatnak levonni szokásaikról, mely komoly adatvédelmi gondokat vethet fel. Ugyanakkor bizonyos szempontból ez egy védelem is nekik, hiszen probléma esetén meg lehet találni őket.

A következő előadást Ed Parsons tartotta a Google-tól. Elmondta, hogy a Google mind platform, mind publikáló jellegű technikai megoldás. Véleménye szerint a személyes adatok nem hátráltatják, inkább segítik az emberek tevékenységét. Véleménye szerint az elhelyezkedés a legfontosabb adat rendszerükben. A jövőben úgy látja a Helyhez Kötődő Szolgáltatások (Location Based Services) egyre fontosabb szerepet fognak betölteni napjainkban.

Az utolsó részben Helen Derbishire az Access Info cégtől, Spanyolország) tartott előadást az adatokhoz való hozzáférés jogáról. Kiemelte, hogy nemcsak a hozzáférésről, hanem az adat újrafelhasználásának jogáról is szó van. Véleménye szerint a legjobb megoldás az lenne, hogy az adófizetők pénzén előállított adatok felhasználása és újrafelhasználása ingyenes lenne.

A munkaülés végén a vitában megemlítettem, hogy az adatokhoz való ingyenes hozzáféréssel egyetértünk, azonban az ingyenes hozzáférést nagyban korlátozzák az országok gazdasági helyzete.

"ePSI platform Berlin – Open Data: Apps for Everyone?

Február 18-án Berlinben került megrendezésre az „ePSI platform Berlin – Open Data: Apps for Everyone?” című rendezvény, melynek összefoglalója két rövid esetleírással kezdve olvasható ebben a cikkben.

Egy települési önkormányzat működéséhez, gazdálkodásának egyes szegmenseihez kapcsolódó adatbázisát, ill. a kapcsolódó szoftverek üzemeltetését magánvállaltra bízta. A tevékenység kiszervezésének szerződésébe gyakorlatilag semmi sem került bele annak vonatkozásában, hogy az érintett adatok, vagy azokból az említett szoftverek segítségével létrehozott hozzáadott értékű adatok tulajdonjoga kit illet, kit tekintenek a felek a továbbiakban az előbbi vagy az utóbbi adatok gazdáinak, ill. kit, vagy kiket az adatok kezelőjének. Rövid időn belül igazolódott, hogy a felvázolt helyzet komoly nézeteltérésekhez vezet a felek között.

Adott egy tömegközlekedési hálózat, melynek digitális térképi és ahhoz kapcsolódó adatai tekintélyes méretű és meglehetőségen komplex tartalmú adatbázist alkotnak. Alapját a különböző tömegközlekedési eszközök útvonalai, megállók koordinátái, nevek és leírások képezik. Állami és magán szervezetek sokasága a közlekedés szervezésétől kezdve, a helyhez kötött szolgáltatásokon át, marketing tevékenységhez, műszaki nyilvántartáshoz és további, több tucat cél érdekében vezet adatbázisokat. Miért alakult ki az a helyzet, hogy az említett adatbázisok alapját képező adatokat, azok változáskövetésével együtt a felhasználó szervezetek jelentős többsége, egymástól teljesen független, önálló rendszerben vezeti? Kinek kedvező ez és kinek nem? Érdemes ezen változtatni, s ha igen milyen gyakorlati lépéseket érdemes tenni ennek vonatkásában?

A fentebbi két kiragadott példa a magánkézben lévő -vagy legalábbis az adatok tulajdonjogát illetően vitatott- eredetileg állami költségvetési forrásokból létrejött adatbázisok, ill. a párhuzamosan vezetett informatikai nyilvántartások problémaköréből merít. Egyik, másik esetleg mindkét esetet áttekintve, néhány olvasóban felmerülhet a gondolat, hogy magyarországi, vagy legalábbis közép-kelet-európai példákról van szó. Számukra is értékes üzenetekkel szolgálhatott a berlini „Open Data: Apps for Everyone?” rendezvény, ahol többek között az is egyértelműen kiderült, hogy a közszféra információinak felhasználásához kapcsolódó, adott esetben az említett példákkal jellemezhető problémák minden uniós tagország számára tartogatnak kihívásokat. Az előbbi egyébként egy franciaországi, az utóbbi pedig egy német város példája.

A találkozó céljaként definiálták, hogy a közszféra információinak újrafelhasználásához, ill. a nyílt adatok témaköréhez kapcsolódóan olyan előadásokat hallgassanak a részt vevők, ill. olyan viták generálódjanak, melyek azon túl, hogy naprakész információk közlésével és a vélemények ütköztetésével segítik a területen való eligazodást és a különböző EU-s tendenciák nyomon követését, egyidejűleg jól mutassanak rá az újrafelhasználáshoz kapcsolódó piaci lehetőségekre.

A rendezvény délelőtti szekcióiban magán és állami vállalatok képviselői tartottak előadásokat, a délutáni blokkban pedig workshopok szerveződtek, melyek keretében a hallgatóság aktív közreműködésével néhány kijelölt szaktekintély vitatta meg a közszféra információihoz való hozzáférés lehetőségeit, akadályait, s a még kiaknázatlan lehetőségeket.

Az előadások és viták nem kizárólag a PSI (Public Sector Information) irányelvhez kapcsolódtak, bár az említett irányelv az aktuális tendenciák eredőjeként jelent meg. Fontos ugyanis, hogy az Európai Parlament és a Tanács 2003/98/EK –tehát immáron 8 éve hatályban lévő- irányelve a közszféra információinak további felhasználásáról szól, s fő célja a tagállamok gyakorlatának megváltoztatása, a közvagyont képező információk üzletszerű hasznosításának lehetővé tétele. Elhangzott, hogy a tagállamoknak mindezt a hazai jogrendszerükbe kell(ett) építeni, melyet az Európai Bizottság megfelelési vizsgálat alá vet. Az ilyen jellegű vizsgálatok első köre 2008-ig lezárult, majd idén 2011-ben újabb követi. Elmondható, hogy bár a közszféra sok helyen „nem rajong” a PSI irányelvért, annak pozitív hatása mégis vitathatatlan.

Felhívták a hallgatóság figyelmét, hogy PSI irányelv számtalan kezdeményezés, projekt, portál és technológiai megoldás létrejöttét indukálta, melyek közül -a teljességre törekedés nélkül- az alábbiak emelhetőek ki:

Akcióterv, mely a lakosság és a vállalkozások bevonásával, e-kormányzati megoldásokon keresztül hivatott a közérdekű döntéseket segíteni. Fontos szerepet kap benne a köz és magánforrások összevonásában rejlő lehetőségek hangsúlyozása.

Digital agenda for europe

Az Európai Bizottság 2010 május 19-én bemutatott Digitális menetrendje, melynek leginkább lényeges elemei az egységes digitális piac létrehozása, az interoperabilitás javítása, az internet iránti bizalom növelése.

data.gov.uk (Opening up government)

Web-portál, melyről elsősorban közadatokat lehet Nagy Britannia vonatkozásában elérni

Egyértelmű, hogy a közszféra információinak - nemzetbiztonsági vagy más jól alátámasztható okoktól eltekintve- jogi vagy technológiai eszközökkel történő visszatartása az innováció és a gazdasági fejlődés gátja. Az érintett adatok és információk publicitása ugyanakkor kiemelkedő szerepet játszhat az államigazgatás iránti bizalom erősítésében, ill. a tagországok egyedi helyzetétől függően adott esetben, a jelentősen megcsappant bizalom felépítésében.

Több területen mutatkozik ésszerűnek az irányelv kiterjesztése, melyek közül az összehangolt licenszpolitika, a nyers adatok szolgáltatásának kötelezettsége, s a nyílt formátumok kérdései a legfontosabbak. Megfelelő meta-információkkal ellátott, könnyen kezelhető technológiai megoldásokkal kereshető és letölthető adatokra van szükség, melyek kapcsán mind a felhasználási, mind pedig az újrahasznosítási lehetőségeket jogilag maximálisan tisztázni szükséges. Határozottan különbséget kell tenni a nyers adatok előállítása, szolgáltatása és a hozzáadott értékű információszolgáltatás között.

A költségeket vizsgálva nagyon fontos különválasztani az adatok előállításának, publikálásának és újrahasznosításának költségeit, melyek között szükséges azonosítani a kormányzati, ill. magánszektor –mint költségviselő- szerepét. A előadók többsége szerint lényeges, hogy a kormányzati oldal fedezze a lehető legkevesebb költséget, s „amit lehet” már a magánszektorra szükséges bízni. Annak tényét viszont, hogy a magánszektor egyelőre korlátozottan használja ki a közszféra információiban rejlő lehetőségeket, nem lenne korrekt kizárólag az államigazgatás felelősségeként feltüntetni. A magánszektornak is törekednie kell arra, hogy érdekeltté tegye a közszférát, adatainak megosztásában. Kétségtelen, hogy sok, tagországonként is egyedi esetben ez meglehetősen problematikus, (pl. kataszteri adatok), de egyik féltől sem várható el, hogy önként vállalná a „lose-win” helyzet előbbi szeletét. Figyelemreméltó ugyanakkor, hogy konkrét üzleti modellt egyetlen előadó sem tudott megnevezni, ill. olyan „legjobb gyakorlat” részleteivel sem ismerkedhetett meg a hallgatóság, mely meggyőzően mutatta volna be a közszféra információinak hatékony üzleti felhasználását.

A rendezvény zárásával nem kerültek kőbe vésett ajánlások megfogalmazásra, nem született „kiáltvány”, csupán az elhangzottak, jelen cikkben felvázoltakhoz hasonló összegzésére került sor, bízva abban, hogy az összejövetel hozzájárult a közszféra információiban rejlő piaci és non-profit lehetőségek bemutatásához és kiaknázásához, a köz- és magánszféra közötti, témában releváns hatékony párbeszéd szorgalmazásához.

A LAPSI projekt figyelemfelhívására a HUNAGI LAPSI csapat részéről két szakértő vesz részt a márciusi berlini műhelyen Juhász Géza Péter (CASCADOSS Magyarországi Egyesület elnöke) és Podolcsák Ádám, a Compet-terra Kft ügyvezetője. Mindketten idén év elején csatlakoztak a HUNAGI LAPSI csapathoz, vállalva a megfelelő LAPSI munkacsoport munkájába való bekapcsolódást, amely nyomonkövetést, akciókban való lehetőség szerinti részvételt, szakanyag véleményezését, beszámoló elkészítésében való részvételt és az ismertetterjesztésében való közreműködést jelenti.

A kiutazók közül az egyesületi szakértő repülőgegy és szállás költségét a HUNAGI LAPSI kerete biztosítja. A küldetést követően a kiutazók a LAPSI Csapat nyílvános ülésén számolnak be tapasztalataikról és gyűjtött imereteikről, de benyomásaikról az ePSIplatform LAPSI számára is fenntartott blogján is írhatnak.

Közérdekű adatok hozzáférhetősége, újrahasznosítása, értelmezések, versenyjog - LAPSI konzorciumi találkozó

A münsteri Wilhelm Egyetem Információ, Hírközlési és Médiatörvény Intézete adott ma otthont a LAPSI projekt harmadik műhelyének, amely a PSI irányelv és az európai versenyjog átfedő területeit boncolta. A műhelynek 24 résztvevője volt, a LAPSI projekt konzorciumi tagjainak képviselői valamint az Európai Bizottság szakértője. Prof. Marco Ricolfi helyzetbemutatását követően öt előadás hangzott el, melyeket vita követett.
Elsőként Prof.Josef Drexl, a Max Planck Szerzői Jogi és Versenyjogi Intézet munkatársa adott összehasonlítást a PSI és a versenyjog közös és eltérő sajátosságairól.

M.T. Maggiolino 17 jogi eseteket mutatott be, köztük a svéd Lantmateriet és egy meteorológiai szolgálat gyakorlatát a PSI és versenyjog szempontjából.

Dr. Julián Valero Torrijos a Murcia Egyetem professzora az „undertaking” gyakorlatáról beszélt.

Dr.Katleen Janssen a közérdekű feladatok ítélésének kérdését elemezte az európai gyakorlat alapján. A leggyakrabb hívatkozás: a törvény írja elő... mert annak tartják..., mert közérdeket szolgál... Itt vita alakult ki az „undertaking” gyakorlat szempontjából. A gyakorlat a kezdeményező előnyös helyzetét mutatja.

A szünetben referenciát kértem az egyik hozzászólásban említett, Amszterdam adatpolitikájával, adathozzáféréssel kapcsolatos kifogásokkal kapcsolatos jogi esetről, valamint a deVries előadásában bemutatott, nemzti meteorológiai szolgálatok közötti, valamint földrajzi információt szolgáltató kiválasztott szervezetek közötti összehasonlító vizsgálatáról (amelyekben többnyire térképészti és kataszteri szervezetek szerepelnek holland, dán, francia, osztrák, brit példák alapján).

The Spatialist project would like to invite you to its second workshop on legal aspects of geographic data, taking place in Leuven, Belgium on Friday 18 March 2011, from 9.30 to 17.00.

This workshop intends to bring together the members of the GI&SDI community whose work and activities are aimed to progress the research, policy and practice with regard to the legal aspects of geographic data, either as a lawyer or as a researcher or professional in other fields closely related with law or policy. The objective of the workshop is to have an annual meeting where we can get an overview of existing research and discuss newly emerging legal issues.
For the second edition, three main themes are on the agenda. The morning session will be dedicated to licensing policies and the possibilities for harmonization. In the first session of the afternoon we will address location privacy, and the second afternoon session will deal with the new calls for a “right to data”. For each theme, there will be two or three short presentations followed by a discussion, to which you are all invited to participate. Speakers include Paul Uhlir (The National Academies), Melanie Dulong-Rosnay (CNRS), Helen Darbishire (Access Info), Ed Parsons (Google), Bastiaan van Loenen (TU Delft) and Eleni Kosta (K.U.Leuven). The exact titles of their presentations will be made available later.

2010 was a big year for the geospatial industry. It was also a big year for matters related to Spatial Law and Policy. Below, in no particular order, are what I consider to be the Top 10 stories related to Spatial Law and Policy in 2010.

1. Europe's reaction to Google Street View. Countries continued to express privacy concerns in 2010 over Google's Street View collection, particularly when it was revealed that in some cases Google was also collecting emails and other personal information. However the response seems to have been the strongest in Europe. One of the results was Germany introduced efforts to regulate mapping efforts such as Street View.

2. Privacy legislation in United States includes "precise geolocation information".
Following a series of Congressional hearings, two pieces of legislation (one introduced and one simply proposed) intending to protect internet privacy included language regulating the collection, use and sharing of "precise geolocation information". The term was not further defined, presumably leaving it up to the Federal Trade Commission (FTC) to address. Subsequently, both the FTC and the Department of Commerce issued reports concerning internet privacy and both referenced location. Geolocation is sure to be a hot topic on Capitol Hill next year.

3. "Free and Open Data". I have seen it alternatively described as "free and open" or as "full and open" spatial data. Either way, there is a growing trend to make spatial data available at as little cost and with as few restrictions as possible. This trend can be seen at the international level, (e.g. Global Earth Observation System of System (GEOSS) and Global Monitoring for Environment and Security (GMES), the national level (efforts to release national data sets under Creative Commons-type licenses) and at the local level (e.g. increased availability of Open Street Map data. This effort could have a significant impact on the ability to combine and use data sets from a variety of sources. It may also result in some data suppliers from holding back their most valuable or sensitive data sets.

4. Mark Brender leaves GeoEye. Those outside the remote sensing industry may not be aware of Mark, but Mark began extolling the many potential benefits of commercial remote sensing in the early 1980's and since then has been actively working to promote the industry and the technology in Washington and the media. Mark left GeoEye this year in order to work more actively with the GeoEye Foundation, an organization he helped start with CEO Matt O'Connell's assistance in 2007. Although Mark will remain active in the industry, his daily efforts to grow the industry will be missed.

5. Warrantless GPS tracking. Courts in the United States issued a series a conflicting decisions in 2010 as to whether law enforcement needed to obtain a warrant before using GPS or other tracking devices to monitor an individual's movements. Confusion on such an important issue is unacceptable. Hopefully it will be resolved in 2011.

6. Law enforcement obtaining customer location information. An important decision was issued by the Third Circuit Court of Appeals this year as to whether law enforcement needed to obtain a warrant before obtaining historical location information about an individual through their cell phone records. Unfortunately, the court punted. This issue is also too important to remain unresolved. In that regard, Congress is looking at updating the relevant portions of the Electronic Communications Protection Act (ECPA). This effort is supported by the Digital Due Process Coalition - a broad coalition of technology companies and think tanks.

7. Privacy lawsuits. In December, there were two lawsuits filed against Apple and a few application developers for collecting personal information, including location, associated with iPods and iPads without the consent of the owner. This is likely to become a bigger issue in 2011 and may include Android phones, given the uncertainty in this area of the law. In a somewhat related matter, Google was forced to pay the Borings of Pennsylvania $1 for trespassing. (You will remember their invasion of privacy lawsuit was dismissed in 2009.)

8. Crowd-sourcing. Crowdsourcing, community remote sensing, voluntary geographic information (VGI), whatever you want to call it, became a big issue in 2010. Undoubtedly, the proliferation of smart phones creates the possibility of a volunteer sensor network. However, it will raise a number of legal and policy challenges, including liability, privacy, national security and intellectual property rights.

9. Ordnance Survey licensing terms. Ordnance Survey has taken a number of hits over the years regarding its policy on licensing of spatial data. Its decision in 2010 to reduce licensing restrictions was an important event. However, from my point of view the discussion and examples it used when discussing issues such as what constitutes a derivative product subject to OS licensing is equally important. Clearly, OS put a good deal of thought into this issue and I recommend it as a useful resource to anyone involved in this area.

10 Accidents involving navigation devices. There were a few high-profile incidents reported in the media related to satnav devices, including one reported fatality. In addition, there was a lawsuit filed against Google claiming an injury related to use of Google Maps. Not surprisingly, plaintiff lawyers are discussing the risks associated with use of such devices."

HUNAGI megkeresésére egy ma délután érkezett intézetvezetői válaszlevél szerint a FÖMI főigazgatói és főtanácsadói szinten tervezi részvételét a HUNAGI LAPSI projekt csapatában.

A FÖMI magas szintű, szakmailag erős képviselete garancia arra, hogy az eredeti terveknek megfelelően alakuljon a magyar projektrészvétel.

A közadatok újrahasznosítása terén ez egyrészről a hazai földügyi tapasztalatok, sajátosságok és törekvések nemzetközi közreadásában ölthet testet a LAPSI fórumain, másrészről az európai jó gyakorlat megismerésével gyűjtött ismeretek hozzájárulhatnak a hazai jogszabályalkotás és gyakorlat finomításához a földügy területén is.

Várhatóan hamarosan megérkezik a visszajelzés a VM Földügyi Főosztálytól, a Neumann-Ház illetékesétől valamint a Magyar Tartalomipari Szövetség elnökétől is közreműködésük megerősítését illetően, ami alapján a munka a tervnek megfelelően megindulhat.
