A projekt nyitótalálkozóján Torinóban Dr. Kovács A. Tamás vett részt, az első LAPSI konferencián Münsterben a HUNAGI főtitkára lesz jelen. 
2012 tavaszán sorra kerülő harmadik LAPSI konferencia és liszencügyi műhely helyszíne Budapest lesz.

"Working Groups

Working Groups are groups of partners that share a common interest for a particular sub-topic of, or a particular disciplinary approach to, the issues of interest to the LAPSI project. The internal structure and decisional processes of each Working Group will be decided on an "ad hoc" basis by the members of the Working Group itself, in order to allow self-organisation according to the changing needs at hand. The only requirement will be for each WG to have a 'rapporteur' who will be the interface between the Working Group and the other members of the network. Contribution to a WG will be open to third parties on an "ad hoc" basis, as decided by the WG itself.
In summary, each WG will:
  • provide input to the members of the project when deciding on the theme of the workshops and conferences;
  • propose relevant speakers for workshops and conferences;
  • provide bibliography and research material;
  • revise and review the scientific content of the reports produced by the Network;
  • provide scientific advice and, where appropriate, review and revise material.

    Spanyol jogszabályelőkészítés a közérdekű adatok újrahasznosítása témakörben

    In any case, here is a short summary:
    The Ministry of Industry, Tourism and Trade and the Ministry of Territorial Policy and Public Administration have developed a draft Royal Decree implementing Law 37/2007 of 16 November, on re-use of public sector information 
    According to the 2011-2015 Strategy of the Plan Avanza 2 adopted by the Council of Ministers on 16 July, the objective of this initiative is to establish, in the field of the Spanish General Administration, detailed rules developing the provisions of Law 37/2007, promoting and facilitating the availability of public sector information for its re-use, both for commercial and noncommercial ends.
    Main elements of the draft Royal Decree
    For this purpose, based on the general framework established by the Law 37/2007, of 16 November, and taking into account the needs identified after the first years of its application as well as in the course of the implementation of the Aporta Project (www.aporta.es), the draft decree regulates the following aspects:
    o        It details the obligations of administrations and public sector bodies in promoting re-use:
    o        Re-use of public sector information is authorized in general, provided that their access is not restricted by access rules.
    o        Administrations and public sector bodies will proactively inform on re-usable information they possess.
    o        Officers responsible for re-use are identified in each ministerial department or public body, establishing also a set of minimum functions.
    o        Relevant coordination mechanisms are established in the field of the Spanish General Administration.

    o        Public Sector Information Catalogue:
    o        Legal support is given to the existing Public Sector Information Catalogue, initially created under the Aporta Project (www.aporta.es)
    o        Administrations and public sector bodies will be responsible for keeping the Catalogue up to date.

    o        Regulation of re-use modalities
    o        The general rule is the provision of re-use under a limited number of general conditions established in the decree. The decree includes a legal notice template setting out the general conditions for re-use.
    o        However, the decree provides some flexibility for those administrations and public sector bodies which need to establish additional specific conditions when deemed necessary.

    o        Regulation of conditions applicable to the re-use of information subject to intellectual property rights or which contain personal data.
    o        The licensing of intellectual property rights attached to re-usable information is streamlined with the re-use modalities established in the decree.
    o        Specific rules are established for those documents which contain personal data so as to ensure the protection of personal data and privacy.
    As provided in the Law 37/2007, the provisions concerning the re-use of public sector information do not change the rules governing access to administrative documents enshrined in our legal system, but provide added value to the right of access contemplating the basic regulatory system for re-use by others of information held by the public sector for commercial or noncommercial ends, in a framework of fair competition, regulating the minimum conditions for a second level of information processing that is generated by public bodies.
    On the other hand, the draft Royal Decree does not develop the system of charges which can be established under the Law 37/2007, of November 16, this being a matter reserved for regulation by law.

    Változások várhatóak a HUNAGI LAPSI Csapat összetételében



    A közérdekű információkra és újrahasznosításukra vonatkozó európai PSI irányelv jogi szempontjait módszertani szempontból vizsgáló hároméves EU ICT PSP projekt (LAPSI projekt) túl van az első félévén.
    A projektben konzorciumi tag a HUNAGI, amely a Leuveni Katolikus Egyetem műhelyével együtt a projektben a térinformatika területét, azon belül is mindenekelőtt a földügyi-térképészet és a kapcsolódó térbeli adatinfrastruktúra szegmenst képviseli. A projekt komplexitása és a hazai kormányzati feladatok szempontjából való hasznossága miatt a projekt kezdetére HUNAGI interdiszciplináris csapatot állított fel, melyben meghívott hazai szakemberek vállalták közreműködésüket a projekt kiválasztott munkacsoportjai tevékenységének nyomonkövetésében, az ahhoz való lehetőség szerinti hozzájárulásban.
    A projekt a HUNAGI közreműködésére olymódon biztosított pénzügyi keretet, hogy az csak a LAPSI munkamegbeszéléseinek, előzetesen egyeztetett disszeminációs tevékenység kiküldetéseire fordítható. Minden más tevékenység, pld. anyaggyűjtés, véleményezés, jelentés, tanulmány és publikáció készítés a szakértő illetve intézményének saját hozzájárulása. Kivételt képez LAPSI rendezvény magyarországi szervezése, lebonyolítása és arról jelentéskészítés. Erre  2012. márciusában kerül sor Budapesten a Közadatok liszenckérdései Műhely , valamint a kapcsolódó 3. LAPSI projektkonferencia megrendezésekor.
    Az élő HUNAGI-  EU ICT PSP LAPSI szerződésben szereplő nevesített közreműködők az alábbiak:

    A HUNAGI elnöke egyetértésével a HUNAGI LAPSI Csapatot a HUNAGI főtitkára vezeti, helyettese a Csapat által választott PSI szakértő dr.Kovács A. Tamás ügyvéd. A megfigyelők a Csapat munkáját véleményükkel, referenciák, szakanyagok átadásával, találkozó-helyszínek felajánlásával segítik.
    Tekintettel a projekt megkezdése óta  bekövetkezett intézményi és személyi változásokra, a HUNAGI LAPSI Csapat összetétele  is szükségszerűen változni fog. (A Csapat egyébként nem zárt, hanem befogadó elven működik.)
    Még ebben az évben a felsorolt személyek részéről megerősítés szükséges arra nézve, hogy a proj
    e
    ktben részt kívánnak venni, egyben az illetékes intézmények vezetőitől kijelölések megerősítését vagy új kijelöléseket várunk. Háttérinformációként a szerződésben szereplő eddig vállalt területeket az 1. táblázat tartalmazza. A LAPSI feladatcsoportok munkájához való magyar oldali hozzájárulásokban vállalt ezen közreműködésüket a LAPSI Csapat tagjai 2010. február 18-i ülésükön fogalmazták meg, majd a projekt hivatalos indítását követően április 29-i harmadik találkozójukon megerősítették.

    Meg kell jegyezni, a projekt megkezdése óta HUNAGI disszeminációs feladatot is vállalt egyrészről a LAPSI céljának, eredményeinek láttatásában regionális (Skopje, WGISS) és világkonferenciákon (GSDI, GEO), amelynek hasznosságát novemberben a projektvezetés is visszaigazolta.
    HUNAGI lehetőséget kapott az ePSIplatform portálján a rendszeres közlésre is.

    HUNAGI közreműködés a LAPSI projekt keretében az első hat hónapban

    A közadatok újrahasznosítása témakörú EU FP7-es projekt a LAPSI elkészítette az első hat hónapos jelentését. A közel 20 konzorciumi tag európai műhely között megtalálható a HUNAGI is, melynek munkáját egy LAPSI Munkacsapat támogatja. HUNAGI hozzájárulása eddig elsősorban információtovábbdásban és fogadókészség erősítésben jelentkezett, melynek beküldött és befogadott összefoglalását a mellékelt táblázat tünteti fel. Ebben még nem szerepel a jelentős előrelépés októberben a GSDI szervezet Jogi és szociális-gazdsági szakbizottsága irányításának átvételével, illetve novemberben a GEO-VII Plenáris ülésen az adatmegosztás cselekvési tervének vitájában tett felszólalás keretében a LAPSI projektre való figyelemfelhívással.

    A PSI Irányelv felülvizsgálata - online konzultáció

    We have received the information from DG INFSO that the online consultation on the Review of the PSI Directive has been launched, see link: http://ec.europa.eu/yourvoice/ipm/forms/dispatch?form=psidirective2010 .
    The website clarifies as follows:
    he Digital Agenda for Europe lists the revision of the Directive 2003/98/EC on the re-use of public sector information (PSI Directive) among its first key actions. It highlights that governments can stimulate content markets by making PSI available on transparent, effective and non-discriminatory terms.  
    This is an important source of potential growth of innovative on-line services. 
    Consultation of interested parties forms part of the review process.  

     The purpose of this open consultation is to gather information from as many sources as possible, including governments, public sector content holders, commercial and non-commercial re-users and other interested parties on their views on the review of the PSI Directive. The consultation will feed into the debate on possible policy options that should be considered for the review, and will contribute to the impact assessment that will be carried out subsequently, associated with proposals for possible legislative or other measures.  

    The consultation includes questions on 1) the PSI re-use context and possible action to consider, 2) substantive issues regulated by the PSI Directive, 3) practical measures, 4) changes that have taken place and barriers that still exist, and 5) other issues to comment regarding the review of the PSI Directive.  

    It will take you approximately 15 minutes to complete the survey. The consultation will close on 30 November 2010.

It takes as a starting point Policy Guidelines for the Development and Promotion of Governmental Public Domain Information, which I wrote as a consultant to UNESCO in 2003-2004 as an input to WSIS.     About the LAPSI project

    LAPSI is a project in the FP7 program of the European Union.
    Legal Aspects of the Public Sector Information and Re-use.

    Role of HUNAGI in the LAPSI Project

    HUNAGI contribution is related mainly to the Geographic Information which are produced, maintained and used in land management, including surveying, mapping, cadastre and land registration, remote sensing and serviced by relevant spatial data infrastructures. From a national economic point of view, the uniform land registration system operating in Hungary is one of the most important databases of the country. This system allows to obtain over the time updated legal and geometric data, as well as other information (e.g. on ownership, land uses, mortgages, etc.). The cadastral maps integrated into the uniform land registration system show spatial relations and references of rights, facts and other information appearing on the property sheets, serving as a basis of engineering planning for the national economy. The national spatial data infrastructure can be built on this uniform, authorized and public land registration system, in small partial modules, following the EU INSPIRE Directive. HUNAGI will participate to all Working Groups and actively take part to Working Groups 01, 03 and 04. It also makes its facilities available to host one of the thematic network seminars or conferences.

    About the Team Leader

    Gabor Remetey-Fülöpp is Secretary General of Hungarian Association of Geo- information/HUNAGI. He holds a degree in Civil Engineering (Budapest) and a second diploma in automation in geodesy. Among his numerous experiences he has been part of the EU Acquis-related institutional development project (1998-2006), of the EC INSPIRE Experts Team (2001-2006), and of the Drafting Team, National SDI Strategy (2004-2006). He also took part to ePSIplus activities.
