Megkezdődött a licencekkel foglalkozó zártkörű budapesti LAPSI Tematikus Szeminárium szervezése


A Gellért szállót választotta HUNAGI a LAPSI Szeminárium helyszínéül. 
A logisztikai részletek egyeztetése a projektvezetéssel a következő napokban várható.  rendezvényre 30-40 szakértő érkezése várható a projekt konzorciumi tagjaitól. Míg az e heti brüsszeli LAPSI konferencia nyílt volt, a budapesti belső műhelymunkában dolgozik majd a licencmodellek témakörében. A brüsszeli konferencián HUNAGI részéről dr. Kovács Tamás ügyvédi irodavezető vett részt, rövid beszámolója hamarosan itt is olvasható.

Jones] that police must obtain a warrant before attaching a GPS tracker to a suspect’s vehicle, voting unanimously in one of the first major cases to test constitutional privacy rights in the digital age. … The court split 5-4 over the reasoning behind Monday’s decision, with Justice Antonin Scalia writing for the majority that as conceived in the 18th century, the Fourth Amendment’s protection of “persons, houses, papers, and effects, against unreasonable searches and seizures” would extend to private property such as an automobile."

"Costa Concordia: Rock Not Charted or Erroneous Navigation?

On the evening of Friday, 13th January 2012, the cruise liner Costa Concordia grounded near the Italian island of Giglio after hitting an underwater rock. This tragic event has raised various questions, including whether the ship was navigating too close to the shore and whether the rock was properly charted.
The vessel was in touristic navigation, passing by the picturesque island Giglio. This is a manoeuvre which is done from time to time. However, this time, the vessel approached the coast very close to the dangerous Le Scole reef area. The minimum distance to the shore usually is a couple of miles. Even inhabitants of the island remarked that the cruiseship appeared to be closer than usual.
According to several sources, the captain of the Costa Concordia has stated that the rock the ship hit was not charted. The vessel has a draught of 8.2m and was sailing approximately 300m out from the shore and the rocks. The area is said to be well-charted, and the place is used for diving and sailing which makes it well-known.
It is not completely clear where the Costa Concordia hit the rock. According to AIS sources, the vessel may have tried to navigate between two rocks with a depth of 10.3m.
After the incident, the vessel navigated close to the shore, towards the harbour. When turning, the vessel listed to one side, which was critical in view of the shallow waters.
The position is not yet stable: on Monday, 16th January 2012, the Costa Concordia moved 9cm downwards. If this continues, due by bad weather for example, she may even slide from the rock, potentially to a depth of 100m.

ADDITION 18th JANUARY 2012
According to Lloyd's List on BBC, the Costa Concordia followed a comparable route in August 2011. No rocks are shown on the UK Hydrographic Office's charts, but the UKHO has stated that this could be due to the small scale of its charts, whereas Italian charts are available on a much larger scale.
The Italian Hydrographic Office is working on a detailed study regarding the charting and survey situation of the location.
A potential source of a new 'liability for GI/map/chart data' case building up? We haven't had many in the past fw years.
But also have a look at this 14 min video tracking the last minutes of the Concordia's approach to the shore - and the basic navigation mistakes that seem to have been made - as well as the fact that the rocks that the vessel first hit are clearly visible on the charts! No escaping the ever present AIS (Automatic Identification System) data.

Public Conference will take place in Bruxelles, on the 23rd and 24th of January 2012.
The two-day meeting will give the opportunity to publicly present the state of the art of the LAPSI policy recommendations on Public Sector Information (PSI) re-use. The featured policies focus on some of the major legal topics involved with the re-use of PSI; in particular, intellectual property rights issues, privacy, data protection and personal data processingcompetition law aspects,regulatory bodies.
The LAPSI members will discuss their policies together with external discussants and experts in the field of PSI, as well as with stakeholders and citizens who want to broaden their knowledge around the topics of PSI and Open Data.

It intends to build a network apt to become the main European point of reference for high-level policy discussions and strategic action on all legal issues related to the access and the re-use of the PSI, namely in the digital environment.
The LAPSI Thematic Network is aimed to produced policy recommendations in view of the impact assessment exercise linked to the revision of the Directive 2003/98/EC scheduled for 2012.

Magyarországi híradás a NAIH-ról a LAPSI és EVPSI honlapok számára

"Data Protection and Freedom of Information Authority in Hungary since January 1, 2012
Significant development in the Hungarian public administration for the protection of citizens has been achieved by setting up a Data Protection and Freedom of Information Authority (in Hungarian: Nemzeti Adatvédelmi és Információszabadság Hatóság). This authority keeps the functions of the previous data protection ombudsman. Having a broader authority in case of abuse of personal data, fines of up to 10 million HUF might be imposed even repeatedly. Attila Péterfalvi, an earlier ombudsman has been appointed by the State President as head of Hungary’s National Data Protection and Freedom of Information Authority for nine years. The independence of the new authority is ensured by legal guarantees and the length of his term spans government cycles. The website of the authority will open under www.NAIH.hu in January. Another important development is the new Act No. CXII of 2011 on Information Rights and the Freedom of Information,  which replaced the former Act No. LXIII of 1992 on the Protection of Personal Data and the Publication of Data of Public Interest by 1 January 2012. LAPSI Consortium member HUNAGI has the intention to invite NAIH Head Dr. Péterfalvi to the LAPSI internal Thematic Seminar and the Data Session of HUNAGI 3rd Conference devoted to Mobile GIS scheduled for 22-23 March, 2012 in Budapest."

Felállt a Nemzeti Adatvédelmi és Információszabadság Hatóság

2012. január 1-jén megkezdte működését a Nemzeti Adatvédelmi és Információszabadság HatóságA szervezet székhelye: 1024 Budapest, Szilágyi Erzsébet fasor 22/C, elnöke Dr. Péterfalvi Attila. A NAIH honlapjának előzeteséről már letölthető a 2011.évi CXII. törvény - az információs önrendelkezési jogról és az információsszabadágról, amely Magyarország új adatvédelmi törvénye.

Role of HUNAGI in the LAPSI Project

HUNAGI contribution is related mainly to the Geographic Information which are produced, maintained and used in land management, including surveying, mapping, cadastre and land registration, remote sensing and serviced by relevant spatial data infrastructures. From a national economic point of view, the uniform land registration system operating in Hungary is one of the most important databases of the country. This system allows to obtain over the time updated legal and geometric data, as well as other information (e.g. on ownership, land uses, mortgages, etc.). The cadastral maps integrated into the uniform land registration system show spatial relations and references of rights, facts and other information appearing on the property sheets, serving as a basis of engineering planning for the national economy. The national spatial data infrastructure can be built on this uniform, authorized and public land registration system, in small partial modules, following the EU INSPIRE Directive. HUNAGI will participate to all Working Groups and actively take part to Working Groups 01, 03 and 04. It also makes its facilities available to host one of the thematic network seminars or conferences.

About the Team Leader

Gabor Remetey-Fülöpp is Secretary General of Hungarian Association of Geo- information/HUNAGI. He holds a degree in Civil Engineering (Budapest) and a second diploma in automation in geodesy. Among his numerous experiences he has been part of the EU Acquis-related institutional development project (1998-2006), of the EC INSPIRE Experts Team (2001-2006), and of the Drafting Team, National SDI Strategy (2004-2006). He also took part to ePSIplus activities.
